Terms of Use

Not legal advice. These are practical MVP terms for an NZ landing page and one-time paid packages. Have them reviewed before taking paid customers at scale.

1. The service

BidPilot helps New Zealand trades and SMEs discover and shortlist public tender opportunities (including government and council notices published via GETS, the government’s tender website), and optionally purchase one-time packages: Should You Bid, Check My Bid, and Write My Bid. BidPilot is not a monthly subscription. It is not a guarantee of contract award. BidPilot does not prepare pricing schedules. Full bid-writing applies only to Write My Bid (and only from information you supply).

2. Independent of GETS / agencies

BidPilot is an independent business and is not affiliated with or endorsed by GETS, MBIE or New Zealand Government Procurement. It is also independent of every buying agency. Official tender notices, documents, clarifications, and submission portals remain on GETS or the agency’s systems. Always verify details on the official notice before you act.

3. Accounts & eligibility

You must provide accurate information and be able to enter a contract under New Zealand law (generally 18+). You are responsible for activity under any login we later enable.

4. Fees, packages & GST

Our promise: missed mandatory requirement = full refund (all packages)

If we miss a mandatory requirement that was in the tender documents, and you're excluded because of it, we refund you in full.

Refunds

Should You Bid: if you have not named a tender and ask us to refund before we begin work, we refund in full. Any package: if you cancel before we begin writing, full refund; after work has started, half. Once the deliverable has been sent, no refund except under the missed-mandatory-requirement promise above. Nothing here limits rights under the Consumer Guarantees Act where it applies.

Fit scores, checks, and draft text are decision aids only. Tender outcomes depend on many factors outside our control. We do not promise wins, rankings, or revenue. The missed-mandatory-requirement refund applies on the terms set out above.

7. Client-supplied facts

Safety systems, insurance limits, qualifications, and referees are used exactly as you enter them. BidPilot does not invent, pad, or “improve” those claims.

8. Intellectual property

BidPilot branding, software, and original content are owned by us or our licensors. Public tender text and metadata remain subject to the rights and terms of the publishing agency / GETS. Deliverables we write for you may be used by you to respond to the named tender.

9. Disclaimer

The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by New Zealand law, we exclude warranties we can exclude. Nothing in these terms limits rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot be limited by law (especially if you are a consumer). If you use BidPilot for business, you agree that consumer legislation may be contracted out of to the extent permitted.

10. Liability

To the extent permitted by law, our total aggregate liability arising from a package is limited to the fees you paid us for that package. We are not liable for indirect or consequential loss, lost profits, or lost opportunities, except where liability cannot be excluded.

11. Free weekly tender list

The free weekly tender list / shortlist signup is optional marketing/content email. It does not create a paid package by itself.

12. Changes & termination

We may update these terms or the service. Material changes will be notified on the site or by email. We may refuse or pause work for non-payment, incomplete intake, or misuse.

13. Governing law

These terms are governed by the laws of New Zealand. Courts of New Zealand have non-exclusive jurisdiction.
